I have over 25 years of experience in commercial litigation and insolvency disputes.  I have advised on and litigated cases which involve, commercial contract disputes for debt recovery, disputes involving legal charges, guarantee disputes, equitable charges and charging orders resulting in orders for sale. I have extensive experience relating to disputes involving directors, shareholders and fall outs within companies.  I am often instructed on cross border litigation involving complex fraud trials, recovery of assets involving all types of technical enforcement processes along with defending and securing security for costs or strike out applications on major litigation cases.

I also have experience in dealing with set off disputes, injunctions pertaining to the dissipation of assets and tracing assets. 

I have a particular specialism in contentious insolvency work. Having previously worked for a big four accountancy firm, I have the hands-on experience and know the need for giving prompt advice taking into consideration the commercial aspects of a case including cost consequences.  I advise directors and bankrupts or creditors extensively in saving assets and defending insolvency related actions.

I advise insolvency practitioners, on corporate and personal insolvency disputes and can bring actions to recover assets under the Insolvency Act. I also have experience in advising creditors in situations where they have suffered a bad debt or have clients who are struggling to pays debts. Often creditors consider that they have lost their money when insolvency of one of their clients occurs but I can advise creditors on the best way forward which could result in a recovery.

I am commercially minded and will always strive to obtain the best result for my client ensuring transparency at all times on costs.

Recent Successes:

  • A major success against a finance company to have an agreement re-written for a consumer on the basis that the agreement was misleading and interest rate charged extortionate. This resulted in a refund to the client, a charge being removed over her property and her not having to pay any further sums.
  • I am currently acting on large cross border litigation for foreign jurisdiction clients and on large fraud cases.
  • I have successfully acted for a creditor of a petition defending a set aside application.
  • I have successfully defended and settled in favour of the client, a complex contract action involving a large multi-national.
  • I have recently advised a Bank on cross-border insolvency related issues which resulted in the Bank taking control of the companies through the Receivership process.
  • I have been successful in defending a complex annulment application in the Court of Appeal where costs were awarded in favour of the client.
  • I have represented liquidators in litigation against high street banks and a large corporate where the liquidators made a very successful recovery with costs in a mediation and again this action involved cross-border insolvency.
  • I have been involved in injunctive relief proceedings to safeguard assets belonging to guarantors when acting for a factoring company and also successfully enforced the legal charge which subsequently resulted in a substantial recovery for the client.
  • I have acted for a trustee in bankruptcy in cases requiring particular sensitivity where the bankrupt and family have pleaded exceptional circumstances and which have resulted in outcomes for the trustee with credibility from the Courts on the sensitive handling of those cases.
