I advise clients in relation to all contentious probate matters, particularly in relation to Will validity, where I advise on issues of mental incapacity, undue influence and any other validity issues, and claims under the Inheritance (Provision for Family and Dependants) Act 1975, acting for both claimants and defendants.

Recent Successes

  • Acted for a Claimant in a spousal Inheritance Act claim which involved a small farm and an estate valued at £1.2m. Following a long (second) marriage, she was not left reasonable provision under the Will and a settlement was reached, following issue of proceedings, which gave her 60% of the estate and a contribution towards her costs.
  • Advised a defendant in a spousal Inheritance Act claim who was the sole beneficiary under her father's Will where the wife was making a claim for reasonable provision. The estate was valued at around £4m consisting of a large portfolio of properties. A settlement was reached at the pre-trial review which resulted in my client securing a portfolio of properties together with a cash payment of over £1m.
  • Acted for a cohabitee in an Inheritance Act claim where she had not been left reasonable provision in an estate consisting of several properties. Following a four day trial, she received judgment in her favour which secured her the property she had shared with the deceased plus payment of her costs.
  • Assisted on a Will validity claim where our client claimed that her mother's Will, leaving her nothing, had been forged. After a three day trial it was found that the Will had been forged and the earlier Will, leaving our client 50% was admitted to probate.
  • Acted for a Deputy in a Court of Protection matter where a young disabled adult needed a Statutory Will. Dealt with the Official Solicitor and the Public Guardianship Office to get the Statutory Will approved.
