Sometimes in life tempers get frayed, fights break out and property gets damaged. However, such actions could see you face allegations of affray or criminal damage, in which case you need early advice from an expert Criminal Defence Team to protect your rights and find the best way forward.

If you use or threaten unlawful violence towards someone and your actions would cause them to fear for their personal safety, you could be accused of affray.

Affray can happen in public or private places and a charge of affray, which could see you jailed for up to three years, can arise even if this hypothetical bystander is not at the scene. If two or more people use or threaten unlawful violence, it is the conduct of everyone taken together that will be considered.

If property was also damaged, you could be suspected of criminal damage and face a prison sentence of up to 10 years (14 years if the incident was religiously or racially motivated).

How we can help

If you are suspected of affray or criminal damage you should contact the specialist Criminal Defence Lawyers at MW Solicitors straight away to ensure you get expert legal advice, that your legal rights are protected and a solid defence formulated.

Our Criminal Defence Team has a formidable reputation for successfully defending allegations of affray and criminal damage, such as pub or street fights, the indiscriminate throwing of objects at crowds, or the wielding of a weapon.

We will handle your case sensitively and professionally, gathering all the relevant facts, examining all the evidence, obtaining expert witnesses and leaving no stone unturned in building you a robust defence.

We will be with you at the police interview stage, where legal advice and a thorough knowledge of your rights are crucial; accompany you to preliminary hearings at the magistrates’ court and fight for your right to bail if you are charged; and ensure you get the top briefs to speak on your behalf if your case goes to trial.

Funding options

We offer a variety of funding options including legal aid (depending on your financial situation and the seriousness of the offence) or you may wish to privately fund your defence.  We offer fixed fees where possible to give you certainty from the outset.

At MW Solicitors, Our Mission is "To make quality legal services accessible to everyone" including those arrested or charged with affray or criminal damage.

An allegation of arson – the offence of causing criminal damage by fire – is treated very seriously and those found guilty can be jailed for life. If you are suspected of or have been accused of such a crime, you need to engage a specialist solicitor to fight your corner as soon as possible.

There is a range of different arson offences that you can be charged with under the Criminal Damage Act 1971.

  • ‘Simple arson’ involves causing damage by deliberately setting fire to something – such as a vehicle in a field or an empty shop, or even your own property.
  • Arson, where someone is reckless as to whether life is endangered, for example setting fire to an aircraft or an apartment in a block of flats where people could get hurt.
  • The most serious offence is ‘arson with intent to endanger life’.
  • If it is not clear whether an arsonist intended to endanger life or was merely reckless as to whether life would be endangered, they may be charged with both offences as alternatives.

Sentences for arson will vary depending on how much damage is caused and what the intent was when setting the fire. All arson offences carry a maximum life sentence on conviction.

How we can help

If you are accused of arson it is imperative to consult a specialist Criminal Defence Solicitor straight away. We will listen to your side of the story and start work on building a robust defence.

Our specialist Criminal Defence Lawyers have successfully defended many cases concerning arson. We will put our wealth of experience at your disposal, collating all the evidence to present the strongest possible case on your behalf.

We will be at your side providing legal advice and ensuring your rights are protected at police station interviews and, if you are charged, will accompany you to all court hearings, striving to win you bail and ensuring you have the top defence team to argue your case.

A ‘zero tolerance’ approach to firearm offences is taken by UK authorities, while the steep rise in knife crime means penalties for being caught with an offensive weapon are harsh. Early expert legal advice is therefore essential if you have been charged with such an offence.

The possession of a firearm – defined by the Firearms Act 1968 as ‘a lethal barrelled weapon of any description from which any shot, bullet or other missile can be discharged’ – is tightly regulated in the UK.

To be caught with a gun without a licence could see you jailed for at least five years, even if you did not know you had a firearm in your possession.

If the police find an offensive weapon on you, you could face up to four years in jail.

Some weapons such as flick knives, swords or machetes are considered offensive per se and you could be charged with possessing one even if you did not intend to injure someone. Other weapons, such as an axe haft or a work hammer could have an innocent purpose, but if the police believe you plan to use it to injure someone, you could face charges.

How we can help

If you are suspected or charged with an offence relating to an offensive weapon you will understandably be distressed and frightened. You will need an experienced Criminal Defence Team who understand what you are going through and will ruthlessly fight your corner.

Our specialist criminal defence solicitors are well used to defending allegations of offensive weapon and firearm offences, such as illegal possession or use of a firearm, possession of an imitation firearm or illegal conversions of weapons.

We will work tirelessly to build you a solid defence, sifting through all the evidence to help find proof of your claims.

We will accompany you to the crucial police station interviews to ensure you get the best legal advice and that your rights are protected. If you are charged, we will be with you throughout the court process, working hard to secure you bail and ensuring you have the top defence advocates to speak on your behalf.

Offences for illegal drugs can take many forms. If you are caught with a Class B “controlled substance” such as cannabis in your possession you can face up to five years in jail, while supplying a Class A drug like heroin carries a possible life sentence.

If you and others hatch a plan to carry out a criminal offence, such as dealing in a Class A drug, this is known as ‘conspiracy to supply’ and a conviction for this could also see you locked up for life.

Penalties for drug offences can be particularly harsh; for example, you can be charged with possession if you only have a small amount, if you did not know it was a controlled substance, or even if it is not yours.

How we can help

If you are suspected of a drugs offence it is essential to consult specialist Criminal Defence Lawyers as soon as possible so they can advise you of your rights and immediately look at every possible defence.

Penalties for motoring offences can differ wildly – from a fine and penalty points for speeding, to the loss of your licence or even your liberty for more serious allegations such as dangerous driving. Whatever the offence, you need a specialist motoring law solicitor to argue your case.

The increased use of modern technology on our roads means that, more than ever, people are having to defend themselves against accusations of motoring offences.

Such charges can be difficult to defend, and the prospect of a guilty conviction can be very upsetting and worrying. It may mean that you might lose your driving licence, face a hefty fine, or even face time in prison.

How we can help

Our specialist motoring law solicitors have many years of experience of successfully defending drivers faced with motoring offence charges including:

  • speeding;
  • driving while under the influence of drink or drugs;
  • causing death by dangerous driving;
  • dangerous driving;
  • driving without due care;
  • driving whilst using a mobile phone
  • driving without insurance or a valid licence; or
  • driving whilst disqualified.

We will listen sensitively and professionally to your side of the story, thoroughly explain the charges against you and the possible consequences. Our solicitors will immediately start work on building you a robust defence.

We will sift through all the available evidence against you – whether this is witness statements, official reports or video footage – rigorously questioning every element and seeking proof to back up your claims.

We understand what a devastating effect the loss of your licence can have on your home, work and family life. If the offence you have been charged with would ordinarily mean you losing your licence, we will forcefully present the reasons why you should be allowed to keep it, or at the very least argue for a reduction in the length of time you are disqualified from driving.

If the charge is more serious and you are arrested, we will accompany you at the crucial police interview stage, ensuring that you get expert legal advice and that your rights are protected.  We will accompany you to all court hearings and make sure that your defence is presented in the strongest possible way.
