If you, or a loved one, has been diagnosed with an asbestos related disease (asbestosis, pleural thickening, mesothelioma or lung cancer) we are here to help.
We will investigate promptly and advise whether you can make a claim against a former employer, or employers, or a third party such as an occupier of a building.
A diagnosis today will be the result of exposure to asbestos dust decades ago; 30, 40 or 50 plus years. A successful claim can be made even if the employer, or employers, that exposed you to asbestos dust are no longer in existence as we can frequently trace an employer’s insurer who was on cover at the time of exposure. Even if you are unsure of the previous or current name of your former employer(s) we can often check their identity via records held by HMRC and Companies House.
The fact that the premises at which you worked are no longer in existence, or vital witnesses are no longer contactable, does not necessarily mean that you cannot still bring a successful claim either.
If your diagnosis was within the last 3 years, or it is less than 3 years since a loved one has died of an asbestos related disease, you are still within time to make a claim. You should contact us as soon as you receive a diagnosis even if you do not find your symptoms particularly debilitating for otherwise you risk your claim being out of time.
Any settlement or award would be on the basis that you may seek further damages at a later date should there be a significant deterioration in your symptoms in the future.
There is no safe level of exposure to asbestos dust. Blue asbestos (crocidolite) is the most toxic and brown (amosite) is more dangerous than white (chrysotile), which is the most common but all asbestos dust is dangerous.
It is not necessary for you to have worked with asbestos to be able to claim. Those who have been exposed to asbestos dust due to being near others who worked with asbestos, or family members who have been exposed as a result of it being on another family member’s work clothes, may also have valid claims.
Mesothelioma claims are often resolved within around 12 months and where no employer, or insurer, can be traced there is a government scheme that will pay compensation and your legal costs.
If you have been diagnosed with lung cancer and have been exposed to asbestos dust it may still be possible to bring a successful claim, even if you have been a smoker.
We Can Help
At MW our experienced team will explain how a claim can be made, what for and steer you through the procedure. We can also advise on the state benefits that can be claimed as a result of a diagnosis of an asbestos related disease. The team will assist by explaining the involvement of the Coroners’ Court if there is an Inquest and our Private Client team can deal with matters such as wills and probate.
The law surrounding asbestos related disease claims is not straightforward and different outcomes will be achieved depending on the diagnosis, the circumstances of the exposure and an individual’s family and financial circumstances.
