The CICA is an agency of the government. Founded in 1964, and reformed in 2012, its role is to provide a means by which victims of violent crime can claim compensation for their injuries, and in certain circumstances, their financial losses, where no other insurance is in place.

How the CICA works

The incident must have resulted in more than just a minor injury, must have occurred within the UK in the last two years and was not caused by a motor vehicle unless it was used as a weapon against you.Before making a claim it is essential that you ensure certain criteria are fulfilled, they are:-

  1. You have been a victim of a violent crime;
  2. The incident was reported to the police and have you assisted in their enquiries;
  3. The incident occurred within the last two years;
  4. You are an adult or, if you were injured as a child, you are under the age of 20;
  5. You have no unspent criminal convictions.

The CICA Scheme covers both mental and physical injuries occurring in consequence of a violent crime. Sexual and physical abuse is also covered.

The CICA will make an award based on their tariff system set out within the Criminal Injuries Compensation Scheme 2012 Guidance Notes .

The CICA will assess and make an award based on the victim’s medical notes and records. In certain circumstances medical reports prepared on behalf of the Claimant will be considered. However, be aware that that the cost of obtaining medical reports by experts recommended to you and not provided by the CICA must be paid for by you as you will not get this back from the CICA.

It is often the case that a victim of crime will sustain a multitude of injuries. The CICA Scheme provides for this but only the most serious injury will receive 100% of the tariff value. Subsequent and less serious injuries will be paid at 30% for the second most serious injury and just 15% for any other injuries.

The CICA will also consider certain expenses and loss of earnings. However, the sting in the tail is that the CICA will not make an award for the first 28 weeks of the Claimant’s absence from work and thereafter, from week 29, will only pay loss of earnings at the prevailing Statutory Sick Pay rate.

On the face of it the claim form is relatively straightforward, and you can complete this yourself. Having legal assistance helps you ensure you have the right medical reports and financial information submitted as your claim.
